PHOTOGRAPH USAGE COPYRIGHT NOTICE

1. The U.S. Olympic & Paralympic Committee Archives (USOPC Archives) provides all available information concerning copyright ownership of photographs requested. While the USOPC Archives endeavors to maintain accurate records regarding copyright ownership, it does not warranty that this information is accurate or complete. 

a. Due to the nature of archival collections, third party rights of privacy, publicity, copyright or trademark are not always identifiable. Unless expressly stated otherwise, the copyright status of materials provided by the USOPC Archives is unevaluated and/or undetermined. 

b. It is up to the Requestor to determine whether an item is protected by copyright or in the public domain, and then satisfy any copyright or use restrictions before publishing or distributing materials provided from the USOPC Archives. 

c. It is likewise up to the Requester to obtain permission from individuals featured in photographs to use their image and/or likeness.

d. Transmission or reproduction of protected items beyond what is allowed by fair use or other exemptions requires written permission from the copyright holder, and the responsibility to secure said permission rests solely with the requestor, not the USOPC.


2. Copyright holders retain all rights to materials in USOPC Archives collections provided to requestors. Possession of images does not constitute copyright ownership or permission to use them, and transmission of copies from the Archives does not imply the transference of such ownership or permission. All images remain the intellectual property of the copyright holder, if applicable. 

3. Subtraction from, addition to, or any other alteration of the provided materials is expressly prohibited.

4. Materials provided by the USOPC Archives are for a one-time, one-project use only, according to the purpose stated in the image request form as submitted and approved. Materials are not to be reproduced, published, or used further without the submission and approval of a separate request.  USOPC consent and permission to use Materials is limited to the express purpose as set forth in the request form and does not extend to additional purposes. 

5. Requestor agrees that it will not use any Materials that feature USOPC trademarks in a commercial manner, or in association with a third party commercial or non-profit entity, without the express written consent of the USOPC.

6. The following credit line near the image, or in a designated image credit section, must be included: “[Photographer name if known, Agency or Company name if known] / “The Crawford Family U.S. Olympic & Paralympic Archives”.

7. Images shall not be used to show or imply United States Olympic & Paralympic Committee endorsement of any views expressed by the requestor or other third parties.

8. As a courtesy, the USOPC Archives requests a copy of images’ use for its records.

9. The Requestor, and anyone claiming on Requestor’s behalf assumes all legal risk resulting from use of materials and hereby releases USOPC, its affiliates, officers, employees, representatives, directors, and agents (“USOPC Released Parties”) from any and all claims, liabilities, obligations, damages, and causes of action based on, or stemming from, claims of intellectual property infringement and/or violations of the right of privacy and/or unauthorized use of an individual’s name, image, or likeness that result from Requestor’s use of the Images.

10. Requester, and anyone claiming on Requestor’s behalf, agrees to indemnify USOPC Released Parties from any and all claims, liabilities, obligations, damages, and causes of action based on, or stemming from, claims of intellectual property infringement and/or violations of the right of privacy and/or unauthorized use of an individual’s name, image, or likeness that result from Requestor’s use of the Images.

By signing below, you certify on behalf of yourself and any affiliated parties that you have read and understood the disclaimers and terms listed below. You agree to adhere to the terms and acknowledge that you assume full liability for any unlawful use of the provided images pursuant to U.S. and International Copyright Law.
